Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.westonwright.com website (the “Service”) operated by Weston Wright (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Membership Agreement
The agreeing individual (the Member, or the Client), hereby indicates their desire to become a member of Weston Wright’s “Never Diet Again” Program pursuant to the terms and conditions of this health & fitness program membership agreement.
Health Attestation
The Member attests that they are fully able to participate in an exercise regimen of their design or choosing without undue risk.
Program Membership Investment
The Member is entitled to a trial of the Never Diet Again ("NDA") Program to watch the Setup Videos. This trial ends at the point of the Completed Setup coaching call. If the Member does not receive or schedule a Completed Setup coaching call, Weston Wright reserves the right to cancel their membership with no further investment required for the Member.
Should the Member agree to join the Never Diet Again Program as a full VIP Member, they agree to pay the following investment, for a minimum duration of 30 weeks.This investment may be paid by automatic debit or credit card transaction with details supplied to a Weston Wright representative, or in full via the website at https://www.westonwright.com/order-page-30-weeks.

Alternate payment options, including fortnightly, monthly or 30 week full payments are available at the discretion of a Weston Wright representative and may be requested by the Member. The Member may continue in the Program for a longer duration than 30 weeks, using the same payment structure.
The Client understands and acknowledges that the membership into the AFM Program entitles the Client to the following:
● Minimum 3 scheduled workouts per week, with progression
● Consistent Nutritional guidelines and support, including MyFitnessPal checking and Accountability from a Coach every Sunday
● Mindset coaching and support
● Program Community and Support
● General Coaching and Support as appropriate to attain desired results
● Saturday “Weekly Temple” reminders to keep tracking and achieving results
● Consistent live videos with science-based information on health/fitness/nutrition industries and elements.
Client Recommended Commitment
:
The Client should aim for the following AFM Program recommended commitment conditions:
● 3 completed and tracked workouts per week
● At least once per week check-ins and interaction in the Facebook community
● Minimum 80% nutritional compliance
● Living by the Program Code
● Consistent tracking using the apps provided
If the Client does not achieve all recommended Commitment goals, a Coach will aim to follow-up with the Client personally to see how the Client can get back on track.
Weston Wright reserves the right to cancel the Client's membership if no or little compliance is shown. If cancelled, he Program investment cost is also cancelled from that date forward.
Fees and payment
The Client confirms their initial payment as identified in the “Program Membership Investment” above is processed to secure their spot in the NDA Program. The Client will be provided 30-week minimum access to the NDA Program, starting from the date payment is received. If the client is not starting their workouts on the week of admittance, payment may commence starting in the following week, at the discretion of a Weston Wright representative.
Guarantor
Should the Client be unhappy with the results from the program, within 28 days of admittance, the Client may request a refund of the payment that was made so far within those 28 days. Request in personal message to a NDA Coach. Should the Client request this refund, their NDA Members Area and Community access is forfeit.
No further payments are made.
Member Access
This membership grants you access to our online NDA Program community, workout and nutrition coaching platform, and to our member site for the duration of the membership, unless this is terminated during.
Indemnification
This membership agreement serves as a liability release, pursuant to which the Member agrees to indemnify and hold Weston Wright harmless against any and all claims of loss or damage without limitation.
Program Rules & Participation
The Member hereby agrees to abide by all posted safety guidelines and regulations while participating in Weston Wright’s programs.
Additionally, the Member agrees to dress and conduct themselves in a manner deemed appropriate for a fitness program.
The Member shall not consume drugs, alcohol, or tobacco products, nor be under the influence of such products while participating in the fitness programs.
The Member agrees to allow Weston Wright to use photographs and video footage of them supplied and posted to Weston Wright social media and the various software platforms included in the program, including Facebook, to be used in marketing materials. This does not include personal posts on the Member’s own personal Facebook feed, and does not include Trainerize photos, unless consent is provided by the Member.
Weston Wright reserves the right to revoke the Member’s access if these terms are violated.
Waiver
The Client shall not, at any time, be obliged to act on any information, suggestion, advice or guidance given by Weston Wright as part of The Program, but if and to the extent that it does so, it shall do so at their own risk.
The Client hereby unconditionally and irrevocably waives any rights of action it may have as against Weston Wright in relation to any such information, suggestions, advice or guidance.
The Client is advised to take independent appropriate professional advice before acting on such advice given within the Program.
Links To Other WebsitesOur Service may contain links to third-party web sites or services that are not owned or controlled by Weston Wright.
Weston Wright has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Weston Wright shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
We maintain ownership over any content or resources made available on or through our website. Using this content for financial gain directly or indirectly or any other use without permission is breaking the agreement of this site and will be seen and treated as a Intellectual Property Theft Infringement.
Governing LawThese Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
ChangesWe reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
Binding Law
This VIP Program membership contract shall be considered binding upon the Member and Weston Wright, and shall be upheld and enforced in accordance with the laws of Queensland. Any legal proceedings related to this VIP Program membership contract shall take place in courts located in Gold Coast, Queensland.
Acceptance
By accepting these terms and conditions in the application, the Member hereby enters into this Program membership contract with Weston Wright in acknowledgement and acceptance of the terms listed above.
